This is a general template for a small SaaS business and does not constitute legal advice. If your business grows or you need specific legal protections, we recommend having these terms reviewed by a licensed attorney.

1. Acceptance of these terms

By creating an account or using Escalium AI ("the Service"), operated by Escalium ("we", "us"), you agree to these Terms of Service. If you don't agree, please don't use the Service.

2. Description of the Service

Escalium AI is a subscription-based chat assistant powered by artificial intelligence, offered under Free, Pro, Business, and Team plans, each with its own daily usage limits and features as described on our pricing page.

3. Accounts

You must provide accurate information when creating an account and are responsible for keeping your login credentials secure. You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service.

4. Subscriptions, billing & cancellation

Paid subscriptions are billed monthly and renew automatically until canceled.
Payments are processed by our payment provider, Lemon Squeezy, acting as merchant of record. We never see or store your full payment card details.
You can cancel your subscription at any time; your plan will remain active until the end of the current billing period, after which it will not renew.
Unless required by law, payments already made are non-refundable, including for partial billing periods.

5. Acceptable use

You agree not to use the Service to: generate illegal, abusive, or harmful content; attempt to circumvent usage limits or security measures; reverse-engineer the Service; or resell access to the Service without our written permission.

6. AI-generated content & limitations

Responses are generated by artificial intelligence and may occasionally be inaccurate, incomplete, or inappropriate for your specific situation. The Service does not provide professional legal, financial, medical, or tax advice. You are responsible for independently verifying any important information before relying on it.

7. Intellectual property

We own the Service, its design, and underlying technology. You retain ownership of the messages, files, and images you submit ("Your Content"). By using the Service, you grant us a limited license to process Your Content solely to provide the Service to you (for example, sending it to our AI provider to generate a response).

8. Termination

We may suspend or terminate your account if you violate these terms, misuse the Service, or fail to pay applicable fees. You may stop using the Service and delete your account at any time by contacting us.

9. Limitation of liability

The Service is provided "as is," without warranties of any kind. To the maximum extent permitted by law, Escalium will not be liable for indirect, incidental, or consequential damages arising from your use of the Service.

10. Changes to these terms

We may update these terms from time to time. If we make material changes, we'll make reasonable efforts to notify you (for example, via email or a notice within the app).

11. Governing law

These terms are governed by the laws of Argentina, without regard to conflict-of-law principles, unless a different governing law is required by mandatory consumer protection laws applicable to you.

1. Aceptación de estos términos

Al crear una cuenta o usar Escalium AI ("el Servicio"), operado por Escalium ("nosotros"), aceptás estos Términos y Condiciones. Si no estás de acuerdo, por favor no uses el Servicio.

2. Descripción del Servicio

Escalium AI es un asistente de chat basado en inteligencia artificial, ofrecido por suscripción bajo los planes Free, Pro, Business y Team, cada uno con sus propios límites de uso diario y funciones, según se describe en nuestra página de precios.

3. Cuentas

Debés proporcionar información precisa al crear tu cuenta y sos responsable de mantener tus credenciales de acceso seguras. Debés tener al menos 18 años, o la mayoría de edad legal en tu jurisdicción, para usar el Servicio.

4. Suscripciones, facturación y cancelación

Las suscripciones pagas se facturan mensualmente y se renuevan automáticamente hasta que se cancelen.
Los pagos son procesados por nuestro proveedor de pagos, Lemon Squeezy, que actúa como comerciante registrado (merchant of record). Nunca vemos ni almacenamos los datos completos de tu tarjeta.
Podés cancelar tu suscripción en cualquier momento; tu plan seguirá activo hasta el fin del período de facturación actual, después del cual no se renovará.
Salvo que la ley lo exija, los pagos ya realizados no son reembolsables, incluso por períodos parciales.

5. Uso aceptable

Aceptás no usar el Servicio para: generar contenido ilegal, abusivo o dañino; intentar eludir los límites de uso o medidas de seguridad; realizar ingeniería inversa del Servicio; o revender el acceso al Servicio sin nuestro permiso por escrito.

6. Contenido generado por IA y limitaciones

Las respuestas son generadas por inteligencia artificial y pueden, en ocasiones, ser inexactas, incompletas o no adecuadas para tu situación particular. El Servicio no brinda asesoramiento profesional legal, financiero, médico o impositivo. Sos responsable de verificar de forma independiente cualquier información importante antes de basarte en ella.

7. Propiedad intelectual

Somos dueños del Servicio, su diseño y la tecnología subyacente. Vos conservás la propiedad de los mensajes, archivos e imágenes que envíes ("Tu Contenido"). Al usar el Servicio, nos otorgás una licencia limitada para procesar Tu Contenido únicamente para brindarte el Servicio (por ejemplo, enviarlo a nuestro proveedor de IA para generar una respuesta).

8. Terminación

Podemos suspender o cancelar tu cuenta si violás estos términos, hacés un uso indebido del Servicio, o no pagás los cargos correspondientes. Podés dejar de usar el Servicio y eliminar tu cuenta en cualquier momento contactándonos.

9. Limitación de responsabilidad

El Servicio se ofrece "tal cual", sin garantías de ningún tipo. En la máxima medida permitida por la ley, Escalium no será responsable por daños indirectos, incidentales o consecuentes derivados del uso del Servicio.

10. Cambios a estos términos

Podemos actualizar estos términos de tanto en tanto. Si hacemos cambios importantes, haremos esfuerzos razonables para notificarte (por ejemplo, por email o un aviso dentro de la app).

11. Ley aplicable

Estos términos se rigen por las leyes de Argentina, sin considerar principios de conflicto de leyes, salvo que una ley de protección al consumidor aplicable a vos exija otra ley.
